According to the unanimous decision of the Supreme Court on Friday, which sets out the conviction of a Federal High Court in Lagos against Orji Uzor Kalu, the Leader of the Senate and former Governor of Abia State.
Senator Orji Uzor Kalu representing Abia North is said to be heading to his Abuja home, after leaving his prison confinement, where he had been since his conviction alongside Ude Udeogu, a former Director of Finance and Account at the Abia State Government House.
The Supreme Court, upturned Kanu’s conviction by Justice Mohammed Idris of the Federal High Court in Lagos on April 24, 2019 on account of pilfering and corruption and Udeogu to 10 years imprisonment on the same day, said the trial should commence de novo (afresh).
In a unanimous verdict on the appeal delivered by Justice Ejembi Eko, the nation’s apex court declared that the conviction of the appellants was null and void on the ground that Idris was already a Justice of the Court of Appeal, as at the time he delivered the judgment sentencing the appellants.
Emphasising that a Justice of the Court of Appeal could not at the same time operate as a judge of the Federal High Court, he ordered the Chief Judge of the Federal High Court to reassign the case for trial.
