Ruth Morrissey, the terminally illย woman from Limerick who sued the HSE and two laboratories over the misreading of her cervical smear test results, died on Sunday morning at Milford Hospice following a prolonged battle with cancer.
A statement published by her solicitor Cian OโCarroll on behalf of her loving husband. Paul said Ms Morrissey โachieved so much in her life and chief among those accomplishments is the love she and Paul shared and the wonderful daughter they brought into this world and raised with love.โ
Ruth morrissey had sued the HSE and two laboratories over for her misreading of her cervical smear tests.
Ruth and her husband Paul won the case and were compensated โฌ2.16m earlier this week.
The High Court heard that Mrs Morrissey was not told until 2018 that a review carried out in 2014 showed smears taken under the Cervical Check screening programme in 2009 and 2012 had been incorrectly reported.
Ruth gave evidence during the case July 2018 and was told that her cancer had returned
The High Court found in favour of the Morrisseys saying that those who examine cervical smear tests should have “absolute confidence” that a slide was clear before passing it as such, a ruling later upheld by the Supreme Court.
โDespite the magnitude of the harm caused to her by avoidable errors, despite the broken promise of a Taoiseach who said no other woman would have to go to trial, despite using Ruth as a test case through the final years and months of her life, neither did HSE nor the State has ever apologised to her, and now it is too late,โ it added.
